The Colombian Civil Code regulates the theory of risk in the contractual relationships that arise from the sale. The buyer is not the owner and bears the fortuitous loss of the thing, having to execute the payment provision knowing that the debtor will not meet theirs, in a situation that threatens the contractual balance of act. The theory is taken from French law, George Ripert (n. d) and adopted by the Colombian law. It is proposed that the cause of the (...) contract, element of formation, and execution of the act is accepted in order to restrict the threat that puts the legal stability of the act at risk. El amor es sentimiento, afecto, inclinación y entrega a alguien, mientras que la obsesión es una perturbación anímica producida por una idea fija. Sentimiento y perturbación son cosas distintas y producen comportamientos bien diferentes. Sin embargo, el amor puede experimentarse como una idea con tenaz persistencia y como un deseo incontrolable.

Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. . A comparison is made between two unlikely debates over intelligence. One debate took place in 1550 at Valladolid, Spain, between Bartolomé de las Casas and Juan Gines de Sepúlveda over the intelligence of the Amerindian. The other debate is contemporary, between John Searle and various representatives of the “strong” artificial intelligence community over the adequacy of the Turing test for intelligence. Although the contemporary debate has yet to die down, the Valladolid debate has been over for four hundred years. (...) The question asked here is whether the contemporary debate can profit from the previous one. The common bond providing the basis for contrast is the issue of the “other” which is present in both debates. From this contrast, the observation is made that the question of meaning is intimately tied to the question of intelligence. (shrink)

Almost all admit that there is beauty in the natural world. Many suspect that such beauty is more than an adornment of nature. Few in our contemporary world suggest that this beauty is an empirical principle of the natural world itself and instead relegate beauty to the eye and mind of the beholder. Guided by theological and scientific insight, the authors propose that such exclusion is no longer tenable, at least in the data of modern biology and in our view (...) of the natural world in general. More important, we believe an empirical aesthetics exists that can help guide experimental design and development of computational models in biology. Moreover, because theology and science can both contribute toward and equally profit from such an aesthetics, we propose that this empirical aesthetics provides the foundation for a living synergy between theology and science. En este artículo se presenta la importancia que le da Hannah Arendt al relato histórico y ficticio como vía para la reflexión ética y política. Se estudia, en primer lugar, cómo los relatos posibilitan la configuración de la identidad, tanto de un hombre como de una comunidad, ya que la narración permite dar sentido a la fragilidad y contingencia propia de las acciones humanas. En segundo lugar se analiza de qué manera la narración permite conservar en la memoria acciones para (...) que no sean olvidadas. Finalmente se estudia cómo el seguimiento de relatos contribuye a la comprensión del mundo humano y a potenciar la facultad de juzgar para superar pensamientos solipsistas, elemento necesario para el ejercicio de una concepción ética y política basada en el reconocimiento de la pluralidad humana. The negative impacts of agriculture on the environment and the inequity that limits access to healthy food for the entire population impede sustainable development. This article reflects contributions to food security and alternatives for transitioning to sustainable food systems. It is concluded that food, as a human right, is a complex and transdisciplinary issue, which must be integrated as a transversal axis in the economic, social, environmental, governance, and cultural dimensions to contribute to sustainable development and therefore the convenience of (...) making the transition from the concept of food security to that of food sustainability. This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

The Lasallian District of Medellin, Colombia requested Corporación Universitaria Lasallista to analyze the formation process received by postulants to De La Salle Brothers in Istmina, Colombia, from 2002 to 2010. Academic, religious, pedagogical, apostolic and personal formation experiences received there were analyzed in this case study –from a qualitative approach– by means of semi-structured interviews and focus groups. Personal and apostolic formations stand out among the results due to the characteristics of Istmina as a proper place for sensibilization and subjugation (...) in proof of vocation. However, the reach of integral formation is questioned because academic formation presented meaningful deficiencies. In conclusion, even though formation experiences in vulnerable contexts are appreciated –and contextualization of learning is deemed meaningful–, participants agree in the necessity of developing strong competences to face educational and apostolic practices. In the intellectual scene of 19th century Colombia, Soledad Acosta de Samper stands out for pioneering the recognition of the significance of women for society. This purpose can be found in her work as a journalist as well as in her essays and literary works. Thus, the aim of the article is to analyze from the standpoint of social criticism how are configured the female characters in the works Dolores: cuadros de la vida de una mujer y Teresa la limeña: (...) páginas de la vida de una peruana. Based on the analysis of these novels, the article seeks to show how she gives voice to the main characters of her work, thus looking into the intimacy of female thinking. With the latter, she not only contributed to the strengthening of the ideals of virtue fostered during 19th century, but also of the necessity of intellectual education of women as a fundamental requirement for the training of ideal female citizens. Rare neuromuscular diseases are a group of pathologies characterized by a progressive loss of muscular strength, atrophy, fatigue, and other muscle-related symptoms, which affect quality of life levels. The low prevalence, high geographical dispersion and disability of these individuals involve difficulties in accessing health and social care services. Teleassistance is presented as a useful tool to perform psychosocial interventions in these situations. The main aim of this research is to assess the effects of a teleassistance psychosocial program on the QoL (...) levels of people with RNMDs who have different levels of disability. A sample of 73 participants was divided into an experimental group, which participated in the intervention, and a control wait list group. QoL was evaluated through the SIP and the SF-36, and disability through the WHO-DAS II. The participants with a moderate to severe level of disability were those who most benefited from the intervention. The results also revealed that the psychosocial teleassistance program was suitable to improve physical and psychosocial aspects of people suffering from a rare neuromuscular disease with a moderate level of disability, but just psychosocial aspects in those with a severe level of disability. Citizen science is growing quickly, given its potential to enhance knowledge coproduction by diverse participants, generating large and global data sets. However, uneven participation in CS is still an important concern. This work aims to understand participation dynamics in CS and how they are shaped by participation barriers and drivers. We do so by examining participation in CONECT-e, a CS project that uses a wiki-like platform to document traditional ecological knowledge. More precisely, we analyze quantitative data on participants’ profile and (...) activity patterns and qualitative data on barriers and drivers of participation. Our findings suggest that overcoming the education, age, and residence participation barriers is challenging even in cocreated CS projects. This is potentially due to issues of perceived self-illegitimacy and low access to information and communication technologies. Our results also point out that participants’ alliance with the project’s objectives and trust relationships with the project team are important drivers of participation in CS projects. Finally, we also highlight the need to think beyond participation as single actions and rather consider participation diversity in CS as functional diversity in ecosystems, with participants performing a diverse set of interconnected tasks or functions. We draw from upper echelons theory to investigate whether the presence of a chief sustainability officer (CSO) is associated with better corporate environmental performance in highly polluting industries. Such firms are under strong pressure to remediate environmental damage, to comply with regulations, and to even exceed environmental standards. CSOs in these firms are likely to be hired as legitimate agents to lead and successfully implement environmental strategy aimed at reducing pollution levels. Interestingly and contrary to our expectations, we found that (...) the presence of a CSO is associated with higher levels of pollution emissions. Nonetheless, we found that the CSO has a positive influence on a firm’s environmental performance if faced with strict environmental regulations. We argue that the enforcement of environmental regulations enhances monitoring and accountability of pollution emissions. The sample for this study comprised all the S&P 500 firms required by the Environmental Protection Agency to annually report their toxic emissions to the Toxic Release Inventory. Data were collected for a 6-year period from 2006 to 2011. We used a panel data regression and employed propensity score matching to correct for potential endogeneity problems. (shrink)

Este artigo apresenta uma revisão de literatura, que possui como objetivo investigar como o fenômeno corpolatria está inserido em publicações científicas. Teve como lócus três portais de buscas (Scielo, Portal de Periódicos da CAPES e Google Acadêmico) e recorte temporal de 2012 a 2021. Os dados foram analisados qualitativamente, no qual, averiguou-se a conceituação de corpolatria destacada na literatura e o local de origem dos estudos. A partir dos resultados, inferiu-se que a temática ainda é incipiente entre os pesquisadores brasileiros, (...) embora haja boa distribuição geográfica dos estudos. Percebeu-se que corpolatria é uma patologia da modernidade, caracterizada pelo culto exagerado do corpo, referendada como uma espécie de ditadura corporal, estabelecida pelo discurso do corpo perfeito. Disseminada pela mídia, pelas redes sociais e pela sociedade, caracteriza-se como uma patologia social à medida que causa mal-estar social, pois pode gerar consequências físicas, transtornos psicológicos e insegurança. El pensamiento y la actividad del movimiento feminista se ha traducido en una conquista de realidades nuevas y diferentes tendentes a lograr la transformación de la situación de dependencia y sumisión de las mujeres respecto a los hombres. Si bien es cierto que a lo largo de este proceso de emancipación las mujeres han cosechado un innegable éxito en las sociedades democráticas, al menos en lo que se refiere a la construcción legislativa, se mantiene una desigual posición de hombres y (...) mujeres en ámbitos diversos. En este sentido, la aplicación de la Ley de Dependencia, ejemplo en nuestro país de ampliación de los derechos sociales, puede tener el efecto no deseado de contribuir al mantenimiento de los roles tradicionales de hombres y mujeres. O crescente desenvolvimento das Tecnologias de Informação e Comunicação (TIC) vem trazendo mudanças significativas nas tarefas realizadas no cotidiano. O presente estudo tem como objetivo identificar como a inclusão digital pode favorecer o empoderamento, a qualidade de vida e o bem-estar das pessoas. Constitui uma revisão integrativa da literatura, realizada em bases de dados científicas. Como critérios de inclusão, optou-se por artigos publicados nos últimos 10 anos (2011 – 2020), em português, inglês e espanhol. O levantamento bibliográfico localizou 47 artigos, (...) dentre os quais nove atenderam aos critérios de inclusão e foram analisados. Os resultados indicaram que a inclusão digital está positivamente associada à qualidade de vida, e essa a índices mais elevados de educação, saúde e segurança econômica. ObjectiveThis study aimed to analyze the influence and measurement of the relationship and interaction between the elderly lifestyles after the appearance of the SARS-CoV-2 variant and the factors analyzed comprised life satisfaction levels, social relationships, and daily-life activities.MethodsThe study population was ≥ 65 in Castile-La Mancha. The research design was quantitative and arose from primary data collected via an ad hoc survey carried out through the Computer Assisted Telephone Interview system by randomly stratified sampling. The sample size was made up (...) of 1,065 cases, and the participants were selected through a random sampling stratified by gender quotas, age, province, and habitat size.ResultsThe results obtained revealed two main lifestyles, from which a notable behavioral change in personal relationships led to infer toward alternative lifestyles.ConclusionNotwithstanding the variation in lifestyles of the elderly after the pandemic, certain relationships remained unaltered. Thus, from the analyzed variables, relatives and friends relationships were scarcely influenced by the supervened incident. (shrink)

RESUMO Este artigo visa promover um diálogo entre os sentidos de “protagonismo” nos campos teatral e educacional, a partir dos estudos de Bakhtin e o Círculo. Para tanto, analisa enunciados presentes em uma pesquisa documental, considerando as ocorrências da palavra “protagonismo” entre os sentidos emergentes, a fim de estabelecer possíveis pontos de contato com a categoria bakhtiniana de autoria. Para a investigação, partimos do texto da Base Nacional Comum Curricular do Ensino Médio e do Projeto Político-Pedagógico de uma universidade federal (...) em diálogo com os sentidos de protagonismo no teatro, em perspectiva educacional. Ao resgatar as cadeias discursivas de cada esfera em particular, a análise permitiu compreender que essa apropriação pela BNCC-EM assume uma nova dimensão discursiva, descaracterizando seus enunciadores e interlocutores originais e não oferecendo subsídios para a construção do protagonismo/autoria. Além disso, evoca um sujeito estudante passivo, refém das determinações do documento que impacta as ações da escola. ABSTRACT This paper aims to promote a dialogue between the senses conveyed by the word “protagonism” in the theatrical and educational fields based on the studies of Bakhtin and the Circle. It analyzes utterances from a documentary study, considering the occurrences of emerging meanings of the word “protagonism” so as to establish possible points of contact with the Bakhtinian category of authorship. From an educational perspective, the investigation stems from the analysis of the Base Nacional Comum Curricular do Ensino Médio [High School National Common Curricular Base] and the Political-Pedagogical Project of a federal university in dialogue with the meanings of protagonism in the theater. By retrieving the discursive threads of each sphere, the analysis allowed the understanding that this appropriation of “protagonism” by BNCC-EM assigns a new discursive dimension to it, decharacterizing its original enunciators and interlocutors and denying subsidies for the development of protagonism/authorship. In addition, it takes learners as passive subjects, who are a hostage to the document’s impositions that impact school actions. (shrink)

Emotional disorder symptoms are highly prevalent and a common cause of disability among children and adolescents. Screening and early detection are needed to identify those who need help and to improve treatment outcomes. Nowadays, especially with the arrival of the COVID-19 outbreak, assessment is increasingly conducted online, resulting in the need for brief online screening measures. The aim of the current study was to examine the reliability and different sources of validity evidence of a new web-based screening questionnaire for emotional (...) disorder symptoms, the DetectaWeb-Distress Scale, which assesses mood, anxiety, obsessive–compulsive disorder, post-traumatic stress disorder, suicidality, and global distress. A total of 1,499 participants completed the DetectaWeb-Distress Scale and specific questionnaires for emotional disorder symptoms, suicidal behaviors, and well-being through a web-based survey. Results indicated that a structural model of 10 correlated factors fits reasonably better in comparison to the remaining models; measurement invariance for age and gender; good internal consistency ; and significant positive correlation with other measures of anxiety, depression, PTSD, or distress, and negative correlation with well-being measures, displaying support for convergent-discriminant validity. We also found that girls scored higher than boys on most of the subscales, and children had higher scores for social anxiety, specific phobia, panic disorder, and obsessive–compulsive symptoms, whereas adolescents scored higher on depressive symptoms, suicidality, and generalized anxiety, but the effect sizes were small to medium for all comparisons. The DetectaWeb-Distress Scale is a valid, innovative, and useful online tool for the screening and evaluation of preventive programs for mental health in children and adolescents. (shrink)

The paper shows how relevant the relationship between theoria and the Holy Scriptures is in order to understand Alfonso de la Torre’s Visión Deleytable. The criticism of the Creation by the allegorical character “Entendimiento” agrees with the tradition of the unbelieving “Marrano” Averroism that culminates in XVIIth century Holland, since de la Torre comes across as a philosopher who dispenses with the knowledge revealed by the Scriptures. On the other hand, the objections by “Insight” concur with a philosophy that aims (...) to harmonize reason and Holy Writ, as in the case of Maimonides. This harmonization turns out perfect in the Prophet because he is inspired by the active intellect. Due to the decisive influence of Muslim and Jewish prophetology on Alfonso de la Torre’s work, we state that this text is a very relevant example of philosophical Mudejarism. (shrink)

Las últimas décadas atestiguan un avance acelerado de la tecnología. El futuro que se augura es asombroso en múltiples sentidos. Camina a pasos agigantados y veloces. Estos hechos abren una serie de acuciantes preguntas que exigen un serio discernimiento y que, alzándose como un desafío para los hombres del tercer milenio que comienza, no dejan indiferente al filósofo, uno de los más indicados para contribuir a su respuesta: ¿cómo se debe valorar este fenómeno?, ¿qué implicancias tiene en la vida humana?, (...) ¿hacia dónde camina el acelerado progreso tecnológico? Preguntarse por lo que es la tecnología y darle el lugar adecuado es urgente para comprender mucho de lo que está sucediendo y afrontar debidamente los retos del mañana. El presente artículo tiene como objetivo contribuir a estas reflexiones desde el pensamiento del filósofo de la ciencia italiano Evandro Agazzi. Luego de una introducción, se presentarán algunas ideas sobre operacionalismo, realismo, ciencia y técnica en Evandro Agazzi; posteriormente, se desarrollarán los conceptos de ciencia y técnica en su propuesta, lo que permitirá desembocar en algunas reflexiones acerca del poder que la tecnología ha otorgado a la humanidad. Most cognitive scientists nowadays tend to think that at least some of the mind’s capacities are the product of biological evolution, yet important conceptual problems remain for all scientists in order to be able to speak coherently of mental or cognitive systems as having evolved naturally. Two of these important problems concern the articulation of adequate, interesting, and empirically useful concepts of homology and variation as applied to cognitive systems. However, systems in cognitive science are usually understood as functional systems (...) of some sort. Thus, to be able to talk about functional systems being homologous requires having a solid, adequate, and empirically articulated concept of functional homology—and the same is true about functional variation. Here I construct an original concept of functional homology that, in my view, adequately systematizes a number of actual uses of the word “functional homology” in a variety of biological disciplines and in ethology. I also propose a number of criteria for the empirical application of the concept that are analogous to the criteria that are currently used in comparative biology, ethology, and molecular developmental genetics. Then I construct a concept of functional variation on the basis of this concept of homology. (shrink)

In this article we identify three previously unnoticed problems with flexible moral theories, i.e., theories according to which different moral rules apply when there is full compliance and when there is partial compliance. The first problem is that flexible theories are necessarily very complex, which undermines their ability to motivate and guide action. The second problem is that flexible theories allow for a troubling kind of (moral) domination: the duties an agent has depend on other agents' willingness to comply. Finally, (...) flexible theories introduce indeterminacy: it is sometimes impossible to determine which moral rules apply. When agents stand at the threshold—i.e., when a different rule would apply if a single additional act of noncompliance took place—it is impossible to determine which rule should apply. (shrink)

El artículo propone el concepto de paranoia política como una categoría muy útil para comprender algunas manifestaciones contemporáneas de las patologías del poder. Para ello se sirve de una perspectiva interdisciplinar, en concreto, del saber proporcionado por el psicoanálisis, la filosofía política, la teología y los estudios literarios o estéticos. El psicoanálisis elaborado por Freud y Lacan permite comprender por qué el sujeto paranoico es un sujeto megalómano e hiper-racional que pretende controlarlo todo. Se trata del sujeto soberano, no sólo (...) adecuado a la sociedad de control definida inicialmente por Deleuze, sino también a una concepción de la filosofía que aspira a la totalidad. Tras abordar la estrecha relación entre paranoia y teoría política conspirativa, el artículo explica por qué la paranoia política contemporánea es un caso de la más radical teología política: el gnosticismo político. Con este último término se hace referencia a una concepción de lo político que reduce al Otro a la condición de enemigo absoluto que ha de ser eliminado. Finalmente se establece una estrecha relación entre la cura de la paranoia política y la asunción de una ontología de la incompletitud. (shrink)
